Terms of Use for Community Benefit Programs

Welcome to the TeleHealth Section (Hospital Component) of the H.A.M. Program offered by Community Benefit Programs, operating under the laws of California. These Terms of Use ("Terms") govern your access to and participation in this online program, which is a court-mandated prerequisite to the in-person component at a Trauma Center as authorized by California Vehicle Code 23509 (Youthful Drunk Driver Visitation Program, YDDVP). By enrolling and checking the acknowledgment box, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

To enroll in the TeleHealth Section, you must check the box acknowledging these Terms during registration on our website (www.cb-programs.org). This action serves as your electronic signature and binding agreement. If you do not agree, you cannot participate in the program. We may update these Terms periodically, and continued use after changes constitutes acceptance of the updated Terms.

2. Program Description and Eligibility

The TeleHealth Section is an online, self-paced educational course (approximately 3-4 hours) comprising video lessons, quizzes, and surveys, hosted on the Thinkific platform. It is a prerequisite to the in-person hospital visit, both sections comprising the Hospital Component of the H.A.M. Program. Completion of both sections is required to receive a Proof of Completion, which may be submitted to courts or relevant authorities in Los Angeles County, California.

  • Eligibility: You must be court-referred to participate, as mandated by California VC 23509. The program is designed for individuals fulfilling legal obligations related to DUI offenses.

  • Geographic Scope: This program is approved for Los Angeles County courts. While reciprocity may exist with surrounding counties, we do not guarantee acceptance outside Los Angeles County, and you are responsible for confirming eligibility with your court or probation authority.

3. User Obligations

As a participant, you agree to:

  • Use one account per individual and not share login credentials with others.

  • Complete the program honestly, in the intended order, without skipping or manually advancing through lessons (e.g., skipping to the end of videos).

  • Use a compatible device (smartphone or computer) with a reliable internet connection, preferably Wi-Fi, and assume responsibility for resolving user-side technical issues.

  • Comply with all applicable laws and court requirements related to your participation.

Failure to comply may result in termination of access (see Section 8).

4. Communications

By enrolling, you authorize Community Benefit Programs to contact you via email and/or text message using the contact information provided during registration (e.g., email address, phone number). These communications may include, but are not limited to:

  • Enrollment confirmation and instructions.

  • Updates on course progress, including reminders to complete lessons or quizzes.

  • Program updates, such as changes to content, schedules, or technical requirements.

  • Surveys or feedback requests to improve the program’s quality and effectiveness.

  • Notifications related to court compliance or certificate issuance.

You may opt out of non-essential communications (e.g., surveys or updates) by contacting us at [email protected] or following unsubscribe instructions in our messages. However, you cannot opt out of essential communications required for enrollment, course completion, or court-mandated reporting, as these are necessary to fulfill the program’s purpose. We will comply with applicable laws, including the Telephone Consumer Protection Act (TCPA), when sending text messages, and you may revoke text message consent by replying "STOP" or contacting us directly.

5. Intellectual Property

All program content, including videos, quizzes, surveys, and downloadable materials, is proprietary to Community Benefit Programs or its licensors and protected by copyright and other intellectual property laws. You may not:

  • Reproduce, distribute, modify, record, or share any program content.

  • Use materials for commercial purposes or in any way not expressly permitted for court-mandated education. You are granted a limited, non-transferable license to access content solely for personal, court-required use.

6. Payment and Refund Policy

Payments are processed in USD via Thinkific Payments (powered by Stripe). By enrolling, you agree to the following Refund Policy, which is a core component of these Terms:

Refund Policy

  • No Refunds: All payments are final and non-refundable once enrollment is confirmed. This applies regardless of personal circumstances, program dissatisfaction, technical issues, or changes in court requirements.

  • Immediate Value: Enrollment provides instant access to materials and a Proof of Enrollment that is honored by local courthouses. Completion of both program components provides a Proof of Completion also honored by local courthouses. These digital deliverables are non-returnable and non-refunded.

  • Chargeback Prohibition: Initiating a chargeback or dispute with your payment provider will not result in a refund. We will provide evidence of your enrollment and agreement to these Terms. Disputes may lead to:

    • Suspension of program access.

    • Invalidation of certificates.

    • Notification to courts/probation authorities.

    • Liability for dispute-related fees or costs.

  • Limited Exceptions (Pre-Enrollment):

    • Duplicate Payments: Accidental duplicate charges may be refunded within 7 business days upon verification, if reported before access.

    • Enrollment Errors: If you enroll in the wrong program and notify us within 24 hours before accessing materials, we may refund or transfer payment at our discretion.

  • Policy Rationale: This no-refund policy ensures program integrity and covers administrative costs for court-mandated education.

7. Disclaimers

  • No Guarantees: Completion of the program does not guarantee driver’s license reinstatement, or specific legal outcomes. You are responsible for verifying program suitability with your court or probation authority.

  • Service Provided “As Is”: The program is provided without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted access. We are not liable for technical issues beyond our control (e.g., user device or internet failures).

  • Geographic Limitation: We do not guarantee program acceptance outside Los Angeles County due to varying county reciprocity agreements.

8. Termination of Access

We reserve the right to suspend or terminate your access to the program, without refund, if you:

  • Violate these Terms (e.g., sharing credentials, attempting to bypass lesson progression).

  • Initiate a chargeback or fraudulent dispute.

  • Engage in conduct that undermines the program’s integrity or court-mandated purpose. Termination may result in invalidation of any issued proofs or certificates and notification to your court or probation authority, potentially affecting your compliance status.

9. Limitation of Liability

To the fullest extent permitted by law, Community Benefit Programs, its affiliates, and agents are not liable for any indirect, incidental, consequential, or punitive damages arising from your participation, including but not limited to:

  • Loss of data, opportunities, or legal standing.

  • Technical disruptions or inability to access the program. Our total liability, if any, is limited to the amount you paid for the program.

10. Indemnification

As outlined in California Vehicle Code 23518.5, you agree to indemnify and hold harmless Community Benefit Programs, its affiliates, and agents from any claims, damages, or liabilities arising from your misuse of the program, violation of these Terms, or failure to comply with court requirements.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your participation will be resolved exclusively in the state or federal courts located in Los Angeles County, California. You waive any objections to venue or jurisdiction in these courts.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy, available at www.cb-programs.org/pages/privacy. Please review it for details on data collection, use, and sharing.

13. Miscellaneous

  • Force Majeure: We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, platform outages).

  • No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

  • Entire Agreement: These Terms, including the Refund Policy, constitute the entire agreement between you and Community Benefit Programs regarding the program.
